Ocean Island Backpacker’s Inn Guest Agreement

PLEASE CAREFULLY READ THIS DOCUMENT TO PREVENT ANY CONFUSION IN THE FUTURE.

1- GENERAL

The guest _____________ will be staying in room/apartment #              , 791 Pandora Ave, Victoria, BC, V8W 1N9, referred to as “the room” in this agreement. The cost of the room will be      $            .00 , which will be paid on or before                  ,2007.  Cash, debit card or credit card can be used to pay the rent and security deposit. If payment is made by credit card, the guest will pay an extra charge consisting of the percentage that OI is charged by the credit card company .If the guest moves out of the room before the end of the rental period or moves in to the room after the start of the rental period, no discount will be given to the guest by OI on the rent paid. The guest may not sublet the room or transfer this agreement to another person. If rent is paid after the first day of this agreement, OI may either charge late rent fees, or the tenant will be required to move out. This decision is at the discretion of OI.

The guest will move in on              ,2007. The guest will pay rent on this day and can move in anytime from 3pm onward. If it is not possible for the guest to move in at this time, he/she will contact OI at least two days beforehand, to arrange another time. A room inspection form will be left in the room for the guest to go over and then must be returned to the Front Desk. 

The guest will stay for a fixed length of time: 1 month               2 weeks        __   , which will end at 11am on                , 2007.   At the end of this fixed length of time the guest must move out, unless another guest agreement offer is made with Ocean Island. Length of stay of all guests is at the discretion of OI.

If the guest wants to stay until the first day of the next month, he/she will inform OI by the second last day of the month. The charge to the guest for the extra day will be the monthly rate for the room divided by the number of days, times two = $______.

If the guest is moving from one room to another within OI, he/she may stay in his/her room until 11am on the first day of the month, at which time he/she will move into his/her new room. This move may take place on the last day of the month whenever possible and must be arranged with OI.

There will be a charge of $50 for a second person to stay in the room for the entire month’s period. For a two week period the charge for a second person is $30. If this number exceeds 2 people, the additional cost will be negotiated.

There will be a maximum of ________ person/ people staying in room overnight. The guest may not have other guests (current or previous) of OI as overnight guests in his/her room.

OI must approve all occupants of the room who did not sign the OI Guest Agreement.

All visitors to the guest’s room must sign in at the Front Desk, and cannot exceed a stay of 1 week. This does not include anyone who has previously stayed at OI; previous OI guests must sign in and pay for a room as a nightly guest if they wish to stay overnight.

2- SECURITY DEPOSIT

The guest has paid a security deposit of $____  __   _ on ____          ____day/month/year.

By paying the security deposit and signing the Ocean Island Guest Agreement form, the guest is committing to renting the premises listed above. If the guest later decides that he/she does not want to move in to the room, Ocean Island will attempt to rent the room to someone else. If OI is able to rent the room to someone else for the full amount, the guests’ security deposit will be returned to him/her, minus an administration fee (20% of the monthly rental rate), to compensate OI for the time and expense of advertising and renting the room a second time. If OI is not able to rent the room for the full amount, the amount of lost rent will be deducted from the guests’ security deposit and kept by OI. The sooner OI knows that the guest will not be renting the premises, the greater the chance is that OI will be able to rent it to someone else, so let us know as soon as possible if your plans change.  

Before the guest moves into the room, an inspection report will be filled out, stating the condition and contents of the room. Both the guest and Ocean Island will sign the report.

The full security deposit will be returned to the guest, unless:

  • The guest fails to pay rent, which is due, in which case the security deposit will be kept as rent. 
  • The guest causes damage to the room and does not repair the damage, removes some of the contents of the room, in which case the guest will be charged the replacement or repair amount.
  • The guest fails to adequately clean the room before vacating it, in which case OI will clean the room at the rate of $20 per hour and will be deducted from the guests’ damage deposit.
  • The guest does not move out on the date and time specified in this agreement, in which case he/she will be charged a late check-out fee of $10 per hour and will be deducted from their damage deposit.
  • The guest loses his/her keys, in which case there will be a $10 non-refundable charge for a replacement set and will be deducted from their damage deposit.
  • The guest fails to respect OI’s NO SMOKING POLICYSmoking in their room or common areas, is considered a breach of guest’s contract, and may be asked to leave. A $50.00 cleaning charge will be deducted from guest’s damage deposit.

The security deposit will be returned 72 hours after the move out date as specified in the contract. The security deposit will not be returned on day of checkout. If the guest is leaving Victoria, OI can mail the security deposit to him/her.

The security deposit will be returned to _____________________________, as noted on the receipt unless otherwise stated below.  If other arrangements are to be made, the guest(s) must notify Ocean Island office Staff prior to their departure.    The security deposit will be returned by cheque only.

The guest is responsible for all damage to the room or any loss of contents during the time he/she has rented it, whether the guest or any other person causes the damage. Before the security deposit is returned an OI staff member must inspect the room. If the guest wishes to be present at the inspection, he/she must pre-arrange this appointment with an OI staff member. Please note OI staff is very busy on the last and first day of the month; to avoid delays, the guest is advised to make an appointment in advance.

3- GUEST CONDUCT

This agreement is for the room only. The guests’ use of the common areas will be restricted in the event of the guest not following the basic guidelines for conduct detailed in this agreement. This will occur only after a warning in all but the most extreme cases, but is at the discretion of Ocean Island staff. This is for the safety, security and comfort of all of our guests.

OI will not rent a current guest a room for the following month in the event of the guest not following the basic guidelines for conduct detailed in this agreement. Ocean Island reserves the right to refuse service to anyone.

The guest will respect other OI guests and OI staff at all times.

Noise must be kept to a reasonable level at all hours, and especially during the Quiet Hours of 1am to 8am.

The guest will respect the OI common areas, by not making an unreasonable noise, or leaving any mess or garbage. The guest will also clean his/her dishes and any mess made in the common kitchen. Please do not keep communal items in your room such as dishes, coffeemakers, brooms, mops, etc. as these should be made available to all guests.

OI may provide linen to the guest, but OI is not responsible for washing the linen.

4- MISCELLANEOUS

To verify the guest’s identity for security purposes, government-issued photo ID must be presented to OI staff.

Ocean Island will respect the guests’ privacy at all times. OI will only enter the room if necessary, and we will inform the guest in advance before entering the room, unless there is an emergency or situation requiring immediate attention, the guest has abandoned the room, or given notice of departure. Situations requiring immediate attention will be at the discretion of OI office staff. OI will conduct up to two regular maintenance inspections in the guests’ room in any month.

Furniture changes will only take place once a month, so be certain of your above selections. They are on a first come, first served basis, and subject to availability. OI does not move refrigerators. Furniture requests are NOT guaranteed.

OI has monthly rooms available for most of the year. The room that the guest is staying in may be available for the next month for the same price, but neither the availability of the room nor the price is guaranteed. Ocean Island will make known the rooms available for the next month between the 1st and 12th of each month. It is then up to the guest to make it known to Ocean Island if he/she wants to stay for an additional month and to complete another agreement for this period.   If the guest(s) should decide to no longer extend their stay at Ocean Island, we ask that the guest give Ocean Island permission to show your suite for renting purposes, between the hours of 11am and 6pm until your room/suite is rented.

As an ongoing PREVENTATIVE PEST CONTROL PROGRAM, OI will need to spray/inspect rooms monthly or as required.  With sufficient notice, the guest will follow the guidelines provided in assisting OI to effectively proceed with their Preventative Pest Management Control Program. OI reserves the right to enter the guest room in accordance with this program. In the event that the guidelines are not followed, OI will proceed to enter the room as scheduled.

OI office hours are 11am to 5pm. The guest can only be sure of being able to contact an OI staff member to deal with any business relating to his/her stay at OI during these times. However, there is usually OI Staff available for most of the day that can deal with some aspects of business relating to the guest’s stay.

If the guest cannot meet OI staff during office hours, he/she can leave a note at the Front Desk. The potential noise level of the specific room the guest will be renting has been reviewed with OI staff and is acceptable to the guest.

Ocean Island will keep the premises in good repair, repairing all damage within a reasonable amount of time. To notify Ocean Island of a necessary repair, call 385-1785 and ask for management. If management is not in, leave a message. If it is an emergency, contact the Front Desk.

CANCELLATION CLAUSE:

I, ______________________, cancel my guest agreement with Ocean Island for the month of _______________, 2007. If this cancellation occurs before I move in, the full amount of rent (if paid in advance) will be refunded. If Ocean Island is successful in renting my room to another guest for the full amount, my security deposit will be returned, minus an administrative fee of 20% of the monthly rental rate for the room – which is equivalent to 40% of the damage deposit in most cases (to compensate OI for the expense of advertising and renting the room a second time). However, if Ocean Island is not successful in renting my room, or rents it for less than the full amount, all or part of my security deposit will be kept by Ocean Island, to offset any lost rent for this month. If the cancellation occurs after I have moved in, I understand that the rent I have paid will not be refunded to me, and that I will receive my damage deposit in due time after my room has been inspected
